# サブウェイの"パン"裁判、16年戦った末に負けを決めたのは糖度だった

パンは、多くの国で主食であり「生活必需品」だ。イギリスやアイルランドでは食料品の多くが非課税とされ、主食であるパンもその代表格とされてきた。

ところが、この"当たり前"をめぐって16年間も国と争い続けた会社がある。舞台はアイルランド。あるサブウェイ店舗を経営する会社が、2004年と2005年に納めたVAT(付加価値税)について、税務署に還付を求めたことから話は始まる。「うちが売っているパンは生活必需食品なのだから、非課税にすべきだ」。当時この店は9.2%のVATを納めていたが、それをゼロに引き下げてほしいという主張だった。

税務署はこれを却下。店側は不服を申し立て、法廷へと争いの舞台を移していく。高等法院でも店側の主張は退けられ、それでもなお争いは続いた。決着がついたのは、実に16年後の2020年。最後に持ち込まれた先は、アイルランドの最高裁判所だった。

最終的に勝敗を分けたのは、難解な法解釈のテクニックではなく、パン生地の成分だった。アイルランドの税法は「パン」を非課税の生活必需品と定める一方で、細かい但し書きを置いている。「生地に含まれる砂糖・脂肪・生地改良剤の重量は、小麦粉の重量の2%を超えてはならない」というものだ。この規定は、甘い菓子パンやケーキ類を「パン」と偽って非課税にする抜け道をふさぐために設けられたものとみられる。この基準を満たさないものは、法律上の「パン」ではなく、通常の税率が適用される菓子類として扱われることになる。

ところが法廷に提出されたサブウェイのレシピを見ると、パン生地の砂糖含有量は小麦粉重量のじつに10%。法律が定めた上限の、なんと5倍にのぼっていた。最高裁はこの数字をそのまま採用し、「これは法律上のパンとは呼べない」と結論づけた。サブウェイのサンドイッチ用パンは、法律の目には「甘すぎる菓子パンのようなもの」として映ったのだ。16年、複数の法廷を渡り歩いてまで求め続けてきた非課税の主張は、最後にはほかでもない自分たちのパンの甘さによって、あっさりと退けられてしまったのである。

考えてみれば皮肉な結末だ。サブウェイは「野菜たっぷりのヘルシーなサンドイッチ」を売りにしてきたブランドだが、その土台であるパンが「甘すぎて法律上パンと認められない」と国の最高裁に断じられたのだから。今もアイルランドでサブウェイの温かいサンドイッチを注文すると、パンには通常の税率がそのまま適用されている。

ちなみに、最高裁まで争った当事者は、サブウェイ本社ではなく、アイルランドでフランチャイズ店舗を運営していたBookfindersという会社だった。一加盟店による節税のための法廷闘争が、ブランド全体を巻き込む大ニュースになり、最後にはパンの甘さを世界へ宣伝する結果になってしまったのである。
